- General – Application of Terms
The terms and conditions of Finnkibuye (hereinafter the “Terms and Conditions”) apply to trade between Finnkibuye and customers. The terms of the agreement also apply to all future transactions, unless otherwise agreed between Finnkibuye and the individual customer in question. Finnkibuye’s terms and conditions may also be applied if Finnkibuye has unconditionally accepted the transaction in the knowledge of the customer’s own terms and conditions that are contrary to our Terms and Conditions or deviate from the Terms and Conditions.
- Customer Communication
The customer must provide an e-mail address at the latest when placing the order. The customer declares that the customer has provided the information correctly and up-to-date. The customer is responsible for any errors or delays due to incomplete or outdated information provided by the customer.
The same email address will also be used for any future orders. If the customer changes their e-mail address, the customer must notify Finnkibuye. The customer must also verify the settings of the e-mail filters in order to receive all possible e-mails sent by Finnkibuye.
Finnkibuye is authorized, but not obliged, to send messages other than by e-mail. The customer is not entitled to demand that the communication be performed primarily by telephone, letter or other alternative means (for example, SMS messages).
Messages sent by Finnkibuye to its customer by e-mail are presumed to have been received by the customer after they have been sent to the customer. If it can be shown that an error has occurred in Finnkibuye’s message transmission, Finnkibuye is responsible. The customer is allowed to send evidence that the missed messages were not caused by the customer’s own actions.
- Order and Contract
The customer can directly choose a product that can be added to the e-commerce shopping cart and paid at checkout. The customer can also request a quote for the product via the contact form.
In order to receive confirmation messages, you must provide a valid and valid email address with your order. The customer is responsible for any errors or delays due to incomplete or outdated information provided by the customer.
By sending the order, the customer accepts a contract with Finnkibuye and undertakes the current Finnkibuye Terms and Conditions. After the customer has received Finnkibuye’s order confirmation by e-mail, a mutually binding agreement has been reached.
- Credit and Personal Information
The customer agrees that Finnkibuye may check the customer’s credit information and process the customer’s personal data in accordance with the applicable law, insofar as the processing of the information is necessary for Finnkibuye’s operations.

- Prices and Billing
Prices quoted by Finnkibuye include VAT. These prices are stated on the condition that the order information provided by the customer in the order offered does not change after the conclusion of the contract.
Subsequent changes due to the customer will be invoiced separately.
By ordering, the customer accepts the payment method.
- Production and Delivery Time
The stated production times are target.
If the product has been ordered with post-delivery, the delivery of the identified products will take place within an average of 3 weeks from the order confirmation. In urgent cases that require an absolute delivery deadline, you should always contact our customer service.
If all the products in the order are already in stock, we try to send the order the next working day.
Delivery takes place by post. Packages can be picked up from service points and parcel machines.
Finnkibuye shall not be liable for delays in deliveries or deliveries if the delay is due to force majeure beyond independent control of Finnkibuye (such as strike, lockout, official regulations, natural disasters, exceptionally difficult weather and other similar unforeseen events) and is essential for the manufacture of the goods. delivery. This also applies if the obstacles in question affect Finnkibuye’s subcontractors or their subcontractors. - Transfer of Risk
If the customer is a trader, the responsibility for the damage or loss of the goods passes to the customer when the goods have been handed over to the party performing the transport or shipment. However, at the latest when the goods leave production. This applies regardless of who pays for the delivery and also if the delivery is performed by Finnkibuye’s own staff. If the customer is a trader and the delivery of the finished goods to the customer or the receipt of these goods is delayed for reasons beyond Finnkibuye’s control, the responsibility for the risk passes to the customer when the readiness for delivery has been notified to the customer
If the customer is a consumer, the responsibility for the damage or loss of the goods passes to the customer when the goods are delivered to the customer or at the moment when the delivery of the goods is delayed due to the customer. At the customer’s request and at the expense of the customer, Finnkibuye may take out transport insurance in case of damage or loss of the goods, if possible.
- Complaint
Defects in the delivered goods must be reported immediately, but no later than within seven (7) working days of delivery.
- Liability for Errors
If the delivered product is incorrect, or it lacks a feature agreed in writing, Finnkibuy will decide alone whether the product will be replaced with a new delivery or whether the error will be corrected. If Finnkibuye does not comply with the customer’s reasonable deadline to do so, does not deliver a replacement product or corrects the defect, or the repair fails, the customer may either cancel the contract or demand a price reduction. No other claims can be made by the customer. Finnkibuye is responsible for the replacement product or repairs in the same way as for the original deliveries. If the product or delivery is partially defective, this can only be complained about in defective parts. The customer’s claims expire in one year, unless mandatory legislation provides otherwise.
- Liability
Finnkibuye is only liable for damages based on gross negligence or willful misconduct. In other cases, Finnkibuye is not liable for damages other than those caused to the product itself, in particular for lost profits or other damages caused to the customer. In case of negligent or intentional personal injury, Finnkibuye is liable in accordance with the mandatory provisions of law. In the same way as Finnkibuye, liability is also excluded from its employees, agents, subcontractors and other assistants.
- Retention of Title
Finnkibuye reserves the right to own all the products it delivers until the purchase price of the contract in question has been paid in full. If the customer is a trader, the right of ownership is reserved until all of Finnkibuye’s receivables in the commercial relationship between him and the customer have been paid in full.
- Payment Due,Set – Off, Withholding
Unless otherwise stated in the order confirmation, the total purchase price of the order (VAT price) is due immediately after the conclusion of the contract (receipt of the order confirmation). Bank charges are the responsibility of the customer. The customer has the right to use only his uncontested or final counterclaims for set-off. The customer has the right to refrain from performance only if he has a counterclaim based on the same contract.
- Applicable Law, Place of Jurisdiction, Nullity of the Contract
Finnish law applies to the terms of the contract and all legal relations between Finnkibuye and the customer. Unless mandatory law provides otherwise, the place of jurisdiction is the court of Finnkibuye’s domicile, but Finnkibuye has the right to bring an action against the customer in all other competent courts. The partial invalidity or invalidity of the terms of the contract or any other agreement between the parties shall not affect the binding nature of the other terms of the contract or any other agreement.

- Information on the Right To Cancel Products
Finnkibuye sells customized products made in Africa. There is no statutory right to cancel a transaction with Finnkibuye for individually manufactured or modified products.
- Liability for Defects and Warranty
Products must be inspected immediately upon receipt by the customer for any defects in delivery. If errors are found, Finnkibuye must be notified of the errors in writing without delay, for example by e-mail. Any complaint must be made no later than within seven (7) days of delivery of the products, subsequent complaints will not be accepted. Finnkibuye is liable for errors in accordance with the terms of the contract and mandatory law, no other warranty is given.
